Acting pursuant to section 56.1.1 and 56.5 of the Act on Public Offering and Conditions Governing the Introduction of Financial Instruments to Organized Trading and Public Companies of 29 July 2005 (Journal of Laws of 2005, No.184, item1583, as amended) J.W. Construction Holding S.A. with its seat("the Company") reports that, in reference to the current report No. 28/2010 of 24 May 2010 r. ("the Report"), regarding the fact of concluding the Joint Venture Agreement ("the Agreement"), the above mentioned Agreement expired on 21 June 2010.

The reason for the expiry of the Agreement was the lack of agreement between the parties of the Agreement, the final content of additional agreements on financing, that were required to conclude. This requirement was disclosed in the previous Report.
The Parties do notexclude the possibility of further negotiations that would be aimed at implementing the investment described in the Report, but only after agreement on content and conditions of agreements, that are supposed to be concluded in the connection with the implementation of the investment described in the Report.
