Change in the value of the established mortgage

Acting pursuant to section 56.1.(1) of the Act on Public Offerings, Conditions for Trading in Financial Instruments in Organised Trading Systems, and Public Companies of 29 July 2005 (Journal of Laws of 2005 No. 184 item 1539, as amended) and pursuant to section 5.1.(1) of the Ordinance of the Minister of Finance on current and periodical reporting by issuers of securities of 19 October 2005 (Journal of Laws of 2005 No. 209, item 1744) (henceforth the Ordinance), J.W. Construction Holding S.A., with its seat in Ząbki, Poland (henceforth the Company) hereby reports that on 7 October 2008 the Company received a Notice from the District Court for Warszawa Mokotów, 10th Division of the Land and Mortgage Register of 30 September 2008 informing of an entry made on 29 August 2008 in the 4th section of the Land and Mortgage Register No. WA4M/00146188/1 maintained by the aforementioned Court for real property located in Warsaw, at ul. Górczewska 181, in perpetual usufruct by the Company and designated as record parcel No. 2/1 from the 6-07-01 area, of 70,030 square meters (henceforth the Real Property). The entry regards a change in the value of contractual capped mortgage established for the benefit of Bank Ochrony Środowiska S.A., 1st Branch in Warsaw (henceforth the Bank). The new value of the entered capped mortgage is PLN 160,000,000.The entry of the aforementioned mortgage was reported by the Company in Current Report 1/2008, a change in the mortgage was reported by the Company in Current Report 27/2008, whereas the remaining information reported in the reports remains unchanged.
