Report's subject: Publication of the verdict regarding the claim brought by the Capital City of Warsaw against the Company 

With reference to the information presented in the reports no. 13/2018 of March 9, 2018, as well as the report no. 12/2016 of September 27, 2016,the Management Board of J.W. Construction Holding S.A. with its business seat in Ząbki(hereinafter known as the "Issuer”) hereby informs on June 4, 2018, the Appellate Court in Warsaw published a verdict (as a court of the second instance) regardingthe claim brought by the Capital City of Warsaw against the Company. The Capital City of Warsaw sought the sum of PLN 14.123.786,25, including the interest and proceedings costs with reference to the payment for the perpetual usufruct for the plot of land no. 2/6 locatedin Warsaw at Górczewska street for the years 2009 -2013. The plot no. 2/6 in accordance with the local zoning plan is meant for communication purposes, i.e. the construction of the NS road. The Appellate Court maintained its verdict of September 27, 2016 in which it ordered the Company to pay to the Capital City of Warsaw the sum pertaining tothe payment of the perpetual usufruct for the years 2009-2013 in the sum of PLN 14.123.786,25, including a dueinterest and the costs of the court proceedings. The Appellate Court ruled on the casefor the second time after its previous verdict was repealed by the Supreme Court on March 9,2018, which constituted a verdict of the Appellate Court of September 27, 2017. Having received a written verdict justification, the Company is considering lodging an appeal to the Supreme Court.
